Supreme Court doesn’t have the power to overturn a likely guilty verdict against Donald Trump in the Manhattan hush money case, according to former federal prosecutor turned attorney Glenn Kirschner.
Trump was recently found guilty on 34 counts related to hush money paid to Stormy Daniels before the 2016 election. Despite his claims of innocence and allegations of political motives, he plans to appeal.
Trump’s sentencing is scheduled for July 11th. The judge, Juan Merchan, will decide whether Trump faces house arrest, probation, or jail. Trump might ask for release on recognizance or post bail to avoid immediate imprisonment while awaiting appeal.
In a recent social media post, Trump urged the Supreme Court to intervene in the case, claiming bias against him. However, Kirschner believes that the Court cannot intervene in this matter.
When discussing the hypothetical scenario of Trump appealing to stay out of jail, Kirschner stated that “I do not think that the Supreme Court is entitled to make a ruling on this issue.” He emphasized that the Supreme Court lacks constitutional authority to intervene in state court sentencing matters.
Elie Honig, a legal analyst, shed light on the potential sentence for Trump, noting that Class E crimes in New York often result in sentences other than prison. The final sentence will be at the discretion of Judge Merchan.
