Representative Lauren Boebert experienced a setback as the judge rejected her request to dismiss the case, dealing a blow just before her primary election.
In 2022, Boebert was sued by David Wheeler from the American Muckrakers PAC for allegedly making false claims that harmed his organization. Wheeler, a Republican, took legal action against Boebert for defamation and trade libel, stating that her remarks had led to a drop in donations to his PAC.
Despite Boebert’s attempt to dismiss the entire case, Judge Kathryn A. Starnella declined and recommended adjustments to certain claims in the lawsuit upon reviewing Wheeler’s request to amend the case.
Starnella suggested allowing Wheeler to modify claims related to interference with contracts and prospective benefits but advised halting other elements of the complaint. Both parties were given two weeks to provide any written objections for further consideration by the District judge.
Starnella concluded that Boebert’s threats to sue the PAC’s donors and sponsors were not protected under state law as they lacked serious intent for litigation and were detrimental to First Amendment rights.
Boebert, currently representing Colorado‘s 3rd Congressional District, decided to run in the conservative 4th District following Ken Buck’s retirement. She won her district in 2022 by a narrow margin and is a strong contender in the GOP primary.
A recent survey by Kaplan Strategies showed Boebert leading with 40 percent support among potential voters, significantly ahead of her rivals. The 4th District, comprising Denver suburbs and conservative areas, leans Republican. However, recent polls indicate a competitive race, with one Democratic survey showing her trailing Ike McCorkle.
